A former Tucson police officer accused of ignoring a woman's arrest warrant in exchange for oral sex is scheduled to be sentenced Monday morning after pleading guilty to attempted unlawful sexual conduct as a police officer. Richard Daniel, a three-year veteran with the department, is scheduled to be sentenced at 11 a. Daniel was arrested in January after police received complaints that Daniel extorted a woman with an active arrest warrant for oral sex or be booked into jail.
Daniel did not the arrest the woman after she reluctantly agreed to perform the act in her apartment, according to court records. Documents say investigators later swabbed part of the apartment's floor and found a positive match for Daniel's DNA. Police arrested Daniel after he returned to the police department.
He was booked into jail on one count of unlawful sexual misconduct as a police officer and one count of tampering with physical evidence. He had been with the department since September Pete Dugan, a spokesman for the Tucson Police Department, confirmed with The Republic that Daniel was terminated and didn't have anything further to say about the case.
Daniel is scheduled to voluntarily relinquish his peace officer certification at a June 19 board meeting, which will bar him from being hired as a police officer in Arizona.
